We will provide services to you subject to the following conditions. When you purchase services or products from BackyardPoets.com you accept these conditions. Please read them carefully.

ELECTRONIC COMMUNICATIONS AND TERMS OF SERVICE

When you visit BackyardPoets.com or send e-mails to us, be aware you are communicating with us electronically and by doing so you consent to receive communications from us electronically. We will or may also communicate with you by e-mail or telephone or by pony express or US Mail and you are hereby notified that you are on the internet [ Gee, thanks Al ]. You agree also that even though this is not written in legal terms and that any and all documents which is, are, were and was, or will be passed or received by either you or BackyardPoets.com or one of its contractors is perfectly fine with you, and you hold absolutely no one responsible over any, and all information electronically sent over the internet or passed or delivered by any other means. You also agree it is an ugly world out there and there are snakes and creeps behind posing as friends. You have of your own free will hired us to provide a service for you and we will try and do our best at completing this task and protect your privacy. If by chance we mess up, you will in no way hold us accountable for Anything, period!

LICENSE AND SITE ACCESS Any and all writing on Doghouspoetry.com belongs to the writers. If you want to download or copy and paste or write it down using pencil, pen, marker or paint brush, any and all written or printed literature, on this site, you must first agree to ask and then receive permission from BackyardPoets.com. and you also agree that you or someone you know or don’t know will in no way profit by anything written on this site unless permission is, was or were to be by granted by the writer. Anything written must be paid for in advance. If there is a dispute, the owner of BackyardPoets.com will decide after seeking council with no one other than me, myself and I, and you by paying for one of our services, trust entirely his [the owner of BackyardPoets.com] ability to use common sense.

This site is owned and operated by a man born in West Virginia and there are others who help, work and sometimes sleep on the job, and I have no idea where they were born. You also agree that at times he [the owner of this site] might go on vacation leaving different tasks to someone he trusts and by doing so constitutes no derelict of duty and in no way is he responsible for anything other than to relax and enjoy his trip. If for a second you think that I, [the owner of Doghousepoetry] am not sincere in writing this, then go read what a lawyer writes. Talk about gibberish! Then look at his bill for how much he wants for writing something that only someone from Mars or another lawyer can, would, could, should, shall, and might understand.

Authors submitting material to BackyardPoets.com for display, are the owners of that stuff, and they (or for any and all services or writers, contractors or any agent of BackyardPoets.com) retain copyright for their material, and it is their’s. Period. When we write something for you after it is done it is yours. Period. We will make an honest effort in completing your job so that you are proud to present the finished or unfinished, writing or editing we have done for you, but please be aware and remember: pride goes before the fall. Doghosepoetry.com requires fees, before project work is completed, at the rate described on the various services pages throughout the site.

BackyardPoets.com does not claim rights to such material by virtue of supplying its services, and will not use or disclose any of it for any reason other than what is necesssary to be able to adequately provide our services. You represent and warrant that you own or otherwise control all of the rights to the material that you submit for service; that the material is accurate; that use of the material you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify BackyardPoets.com and/or its affiliates for all claims resulting from material you supply.

Doghousepoetry takes no responsibility and assumes no liability for any material submitted by you or any third party. BackyardPoets.com provides advice on changes which you, your publisher, or other third parties may accept, reject or further amend. Content of any finished work is therefore entirely the responsibility of the author or other persons to whom author delegates, licenses or otherwise assigns control over their work. Our work on any manuscript does not imply any endorsement of its content or of the author.

BackyardPoets.com, expressly prohibits the association of BackyardPoets.com, and any BackyardPoets.com, trademark, editor, affiliate, or personnel, with any published work, including by way of acknowledgement. In no event is BackyardPoets.com liable for damages in excess of the amount paid by a customer for the service in question. BackyardPoets.com has set its prices and created this site in reliance on the limitations of liability and disclaimers of warranties and damages set forth herein, and the same form a fundamental and essential basis of the bargain between the parties. They shall apply even if the contract between you and BackyardPoets.com is found to have failed in its fundamental or essential purpose or has been fundamentally breached. You specifically acknowledge and agree that BackyardPoets.com is not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied with any BackyardPoets.com, or with any of BackyardPoets.com terms and conditions, your sole and exclusive remedy is to discontinue using BackyardPoets.com services.

While we endeavor to ensure that any files originating at this site are free of known computer viruses, we make no warranty or guarantee that files are virus free, and we are not able to provide any assurances with respect to e-mail or attachments which may have originated with third parties. All recipients are cautioned to check all e-mail, attachments and other computer files before accessing them, and any and all risk of virus contamination is assumed by the recipient. CUSTOMERS BackyardPoets.com is committed to providing exceptional editorial and writing services at affordable prices, and our goal is to have one of the highest customer satisfaction rates on the Internet.

However, BackyardPoets.com is not obligated to refund the purchase price of any service under any circumstance unless explicitly agreed by BackyardPoets.com. If applicable, any refund will be granted within ten business days from receipt of a request. Price, terms and availability are subject to change without notice. All prices quoted are in US dollars unless otherwise stated.

BackyardPoets.com and its affiliates reserves the right to limit quantities, to request payment prior to delivery of service, to refuse service, or cancel orders in (at) their sole discretion. BackyardPoets.com may, at its sole discretion, offer monthly invoicing arrangements to regular business and personal customers, and agree to additional or modified terms for such arrangements. Unless otherwise agreed in to writing, payment is due when invoice rendered. In special cases when NSF checks and payments are more than 90 days past due, they may be subject to administrative charges of up to US$50, and interest at a rate of 1.5% per month (19.56% APR).

PRIVACY Please, we the staff and writers, will try and keep all things within our group, and I will not sell your information to a 3rd, 4th, 5th, or 6th’s party. All your vital information will be stripped before it is given to a writer and they will just see a number and your first name, but with your permission, we will give the writer your e-mail or phone number or both, in order to fine tune each requested order.

OTHER: This site and this agreement is governed by the laws of God, and is its operations is based and located in the state of California, excluding any conflicts of law provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any legal action against BackyardPoets.com or any of its contractors or the owner, you hereby do agree to, must be hand carried and filed through the court system in downtown Brazzaville, Congo, and their decision is binding, after a twenty-five year cooling off period.

Oh, and by the way if any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Also if you have read or did not read this agreement before or after any period in time it makes no difference, because you hold no one responsible except yourself for choosing us. However, having stated this, we, at BackyardPoets.com, can assure all clients that having satisfied customers is our highest priority.
